1. Acceptance of Terms

Welcome to Mishqat ("Mishqat," "we," "us," or "our"). By accessing or using our website, mobile application, or other services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

2. Eligibility

You confirm that you are at least 18 years old and have the legal capacity to enter into binding agreements under the laws of Pakistan. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. User Registration & Account Security

• You agree to provide accurate, current, and complete information during registration and maintain the accuracy of your account information.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• You agree to notify Mishqat immediately of any unauthorized use of your account.

4. User Data & Profile Information

• You grant us permission to collect, store, and process your personal information as outlined in our Privacy Policy.
• You may upload photographs, personal preferences, and other profile information to enhance your experience and increase your chances of meaningful matches.

5. Connection Requests & Admin Approval

• Mishqat offers a unique feature where connection requests sent by one user to another will only be visible to the recipient after approval by Mishqat's administration team.
• The administration reserves the right to approve or reject connection requests at its sole discretion, based on our internal criteria to ensure user safety and maintain service quality.
• Users agree to abide by this moderation process and understand that delays or rejections may occur.

6. Monthly Plan & Payments

• Mishqat offers payment plans that provide access to enhanced features and benefits for a specified period (for example, monthly).
• When you purchase a plan, the payment covers the full plan duration. Your monthly plan will not renew automatically once the term ends.
• To continue using premium features after your plan expires, you will need to renew your monthly plan and re-enter your payment details.
• If you choose to cancel your plan before the end of its current term, your account will be immediately downgraded to the Starter Plan, and you will forfeit any remaining time or benefits associated with your paid plan.
• If you simply wish to stop payments, you can let your monthly plan expire naturally—it will end automatically at the close of the current period with no additional charges.
• All monthly plan fees are non-refundable except where required by applicable law.
• By completing a purchase, you authorize Mishqat (and its payment partners) to process your payment according to your chosen monthly plan and the terms stated herein.

7. User Conduct & Responsibilities

• You agree to use the Service for lawful purposes only and not to upload, post, or transmit any content that is unlawful, harmful, abusive, defamatory, invasive of privacy, or otherwise objectionable.
• Harassment, fraudulent behavior, or attempts to exploit other users are strictly prohibited.
• Mishqat reserves the right to suspend or terminate accounts involved in violating these Terms without prior notice.

8. Intellectual Property Rights

• All content, trademarks, logos, software, and materials on the Service are owned or licensed by Mishqat.
• You may not copy, modify, distribute, or create derivative works without prior written consent from Mishqat.

9. Limitation of Liability

• The Service is provided "as is" without warranties of any kind, express or implied.
• Mishqat does not guarantee the accuracy or completeness of any user profiles or information.
• Mishqat shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use or inability to use the Service.

10. Indemnification

You agree to indemnify and hold harmless Mishqat, its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses arising out of your violation of these Terms or your use of the Service.

11. Termination

• Mishqat may suspend or terminate your account for violations of these Terms or at its discretion.
• Upon termination, your right to use the Service immediately ceases, and Mishqat may delete or anonymize your data according to the Data Retention Policy in the Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising out of or related to these Terms or the use of the Service shall be resolved exclusively in the courts located in Pakistan.

13. Changes to Terms

Mishqat reserves the right to modify these Terms at any time. Updated Terms will be posted on our website, and your continued use of the Service after such changes constitutes your acceptance.

14. In-Person Meetings and Liability Disclaimer

Mishqat is a platform designed to facilitate online connections for matrimonial purposes. If users choose to meet in person, they do so at their own risk and discretion. Mishqat does not conduct background checks or criminal screenings on users beyond the information voluntarily provided. While we strive to promote a safe environment, Mishqat is not responsible or liable for any outcomes, damages, or incidents—including but not limited to personal injury, financial loss, emotional distress, or any form of harm—that may arise from in-person meetings or interactions between users outside the platform. Users are strongly advised to exercise caution, conduct their own due diligence, and meet in public places when interacting with others from the platform.

15. Refund Policy

At Mishqat, we strive to provide a transparent and valuable service for all users. Please read our refund policy carefully before subscribing.

1. No Refunds After Payment

• All payments made for subscription plans are non-refundable, whether the user actively uses the platform or not.
• Once a payment is processed, it cannot be reversed or returned under any circumstances.

2. Duplicate Payments

• If a user is accidentally charged twice for the same service, they may contact us at support@mishqat.com within 3 days for a full refund of the duplicate charge.

3. Payment Disputes

• All disputes must be raised via email with supporting evidence. Mishqat reserves the right to approve or deny refund requests based on internal investigation.

4. Changes to This Policy

Mishqat reserves the right to update or modify this refund policy at any time. Users are encouraged to review it regularly.
